Criminal defence

If you or your business are facing criminal proceedings, our insurance policy can help cover the legal costs. This includes the costs your business might face to: 

  • Defend against a prosecution in a court of criminal jurisdiction 
  • Provide legal representation during an interview under caution 

Property, landlord and tenant disputes

Disputes over property can be challenging. That’s why FSB members have insurance in place to cover legal representation when pursuing any dispute or legal proceedings relating to: 

  • nuisance or damage to the business premises 
  • a breach of a repairing covenant in a Lease 

You’ll also have comprehensive cover for your business whether you own the property or land or are a tenant.

Cover is provided for pursuit actions and additional protection below is provided to defend legal actions against you:

  • Trespass
  • Right of way disputes
  • Title disputes
  • Damage to property
  • Eviction of a tenant

Employee extra protection

Being out of action when your small business needs you can be a worry. Your costs are covered should you need to start legal proceedings for a business-related injury. 

Should you need to take out an injunction following an assault or other threatening behaviour towards you or your staff, your business’ costs can be covered.  

Regulatory compliance

If any of your essential Licences are under threat of suspension, revocation, alteration or non-renewal, we can cover your legal representation fees. 


If you are in a dispute or have been notified of legal proceedings taken out against you or your business under the Data Protection Act 2018 or GDPR, we can cover your legal representation fees.

Intellectual property cover

This cover applies to copyrights, trademarks and passing off actions. You don’t register copyrights or passing off at The Intellectual Property Office, but it’s easy for businesses to infringe another’s Intellectual Property during the normal course of business.

The cover undertakes an assessment of prospects for the legal action and provides you advice as to whether commencing an action is wise. Intellectual Property disputes can be extremely expensive, and protection is not provided for a full legal action. Sometimes, commencing a legal action may not be in your interest and you will be advised if this is the case. The cover provides up to £1,000 of legal assistance and where appropriate to do so will extend to include a cease-and-desist letter.

Court attendance costs

Being called away from your business can have many consequences, including to your bottom line. Access up to £250 per day (£2,500 maximum) for losses to your business if you or an employee in your business attends court as a juror.

Employment dispute insurance

If you’re facing an employee dispute, you’re not alone. We’re here to help you with covering the costs for legal representation at an employment tribunal and any basic or compensatory awards, as well as certain financial penalties. 

You don’t need to be facing an employment tribunal to access support. We have extended legal representation to assist you at Acas early conciliation. This process commences before a tribunal claim starts and provides expert representation to determine your best interests which may be to negotiate and settle early or to withhold from negotiations and defend any future claim that may be brought when an ET1 claim form is received from the Tribunal.

The employment section of cover is also strengthened and will support you at a pre-hearing to determine where a worker alleges that they are an employee.
